GLOBAL FORWAY DETERMINATION ON THE MANDATORY STANDARD ON ACCESS PRICING

DETERMINATION NO. 1 OF 2017

(In compliance to Ministerial Direction to Determine a Mandatory Standard on Access, Direction No. 2 of 2003 and sections 55, 56, 104(2) and 106 of the Communications and Multimedia Act 1998 [Act 588])

Citation and commencement

1. This determination may be cited as the Global Forway Determination on the Mandatory Standard on Access Pricing, Determination No. 1 of 2017.

Definitions and Interpretation

2. For the purpose of this Determination, unless the context otherwise requires,

(i) any term used in this Determination shall have the same meaning as in the Act or the subsidiary legislations made under it;
(ii) words in the singular include the plural and vice versa; and
(iii) the following terms used in this Determination shall have the stated meaning:

”Access List Determination” means the Commission Determination on Access List, Determination No. 2 of 2015;

“Access Provider” means:

(a) a network facilities provider who owns or provides Facilities; or
(b) a network service provider who provides Services; and
(c) who is a licensee as defined in the Act;

“Access Seeker” means a network facilities provider, a network service provider, an applications service provider or a content applications service provider who is a licensee as defined in the Act and who makes a written request for access to Facilities and/or Services;

“Facilities” means network facilities and/or other facilities which facilitate the provision of network services or applications services, including content applications services, as listed in the Access List Determination; and

“Services” means network services and/or other services which facilitate the provision of network services or applications services, including content applications services, as listed in the Access List Determination.

Licensees subject to the Mandatory Standard on Access Pricing

3. Any person who is a licensee as defined in the Act and who acts in one or more of the following capacities is subject to the Mandatory Standard on Access Pricing:

(a) network facilities providers, in their capacity as Access Providers or Access Seekers;
(b) network service providers, in their capacity as Access Providers or Access Seekers;
(c) applications service providers, in their capacity as Access Seekers; or
(d) content applications service providers, in their capacity as Access Seekers.

Mandatory Standard on Access Pricing

4. The Mandatory Standard on Access Pricing shall cover the Facilities and Services that are listed below, and shall be effective from until 31 December 2020.

5. The prices for the provision of the Facilities and Services shall not exceed the maximum prices as prescribed below:

(a) Fixed Network Origination Service

The prices below for Fixed Network Origination Service shall be applied for the carriage of voice communications only.

(b) Fixed Network Termination Service

The prices below for Fixed Network Termination Service shall be applied for the carriage of voice communications only.

(c) Mobile Network Origination Service

The prices below for Mobile Network Origination Service shall be applied for the carriage of voice communications only.

(d) Mobile Network Termination Service

The prices below for Mobile Network Termination Service shall be applied for the carriage of voice communications only.

(e) Interconnect Link Service

(f) Wholesale Local Leased Circuit Service

(g) Domestic Connectivity to International Services

The prices below for Domestic Connectivity to International Services shall be applied for connection services between the Access Seeker’s equipment to the submarine cable system.
